Limitation of the Claim and Obviously Aimless Initiation of Enforcement Proceedings. Gloss to the Resolution of the Supreme Court of April 26, 2022, III CZP 91/22
The institution of ex officio consideration by the enforcement authority of the expiry of the limitation period for a claim, stated in the enforcement title, raises objections of an axiological nature and it is justified to formulate de lege ferenda postulate to remove it from the Code of Civil Procedure.
Because of the above-mentioned problems of axiological nature, de lege lata it is necessary to propose a partial solution to the problem consisting in the use of methods of extra-linguistic (teleological and systemic) interpretation of Art. 804 § 2 of the Code of Civil Procedure and art. 30 Law on Bailiff Costs. The application of such an interpretation leads to the thesis according to which the aimlessness of initiating enforcement proceedings due to the expiry of the limitation period can be established, as a rule, only after the debtor manifests the will to avoid responsibility. This may be done by submitting an application for discontinuance of enforcement proceedings pursuant to Art. 825 point 11 of the Code of Civil Procedure or filing an opposition claim pursuant to Art. 840 of the Code of Civil Procedure. An exception may be allowed only in relation to an application for initiation of enforcement proceedings involving a claim against the consumer, because then Art. 804 § 2 of the Code of Civil Procedure can be applied.
Therefore, the opinion of the Supreme Court expressed in the thesis of the glossed resolution does not deserve acceptance for reasons of axiological nature, in the part relating to claims other than claims against consumers.
