The Gloss to the Resolution of the Supreme Court of October 7, 2021, III CZP 52/20
The gloss of approval to the resolution of the Supreme Court concerns the discontinuation of enforcement proceedings by virtue of the law itself, on the basis if the repealed Art. 823 of the Code of Civil Procedure and costs related to it.
The Author of the gloss agrees with the Supreme Court’s interpretation of Art. 52 sec. 2 of the Act on bailiffs’ costs and the arguments presented in the justification of the resolution, in which the Supreme Court emphasized that the creation of retroactive standards in the field of tribute law is definitely inadvisable, which should be taken into account as an important interpretative directive when interpreting this provision, especially during the examination by common courts complaints against the bailiffs’ actions (and complaints against court’s decisions on the costs of enforcement proceedings.
Keywords: discontinuation of enforcement proceedings under the law itself (ex lege), costs of enforcement proceedings, bailiffs’ costs, creditor’s inactivity
