ABSTRACT
Serving Court Letters. Commentary on Art. 133, 135, 136, 139 and 139(1) of the Code of Civil Proceedings Amended with the Act of 9 March 2023
This analysis presents consecutive regulations of the Act of 9 March 2023, namely the regulations that modify provisions of the Code of Civil Proceedings that concern serving court letters. First of all, the amendment to art. 133 § 3 of the Code of Civil Proceedings was discussed, which adapts statutory terminology to other changes introduced under the Act of 9 March 2023. Next, comments were presented on the 3rd sentence added to art. 135 § 2 of the Code of Civil Proceedings that concerns the service of court letters to a post office box of a party. After that, the added art. 136 § 5 of the Code of Civil Proceedings was analysed, which obliges a party entered into CEiIDzG (Central Record and Information on Economic Activity) to notify a court of changes of service address disclosed in CEiIDzG. Then, the amendment to art. 139 of the Code of Civil Proceedings was presented that concerns the method of notifying dispatches and effects of the failure to disclose a change of service address in CEiIDzG. Finally, the changes to art. 139(1) of the Code of Civil Proceedings were discussed that concern the service of court letters or pleadings via a bailiff.
