The commentary provides a critical analysis on the Court of Appeal in Gdańsk’s judgment of 21 July 2025 (III AUa 1093/24, III AUz 397/24), which denied court bailiffs the right to pay health insurance contributions on a flat-rate basis (tied to average wage) and held that they must calculate their contributions like entrepreneurs based on actual income. The author argues that this interpretation is incorrect, as it overlooks the unique status of bailiffs as public officials and. The commentary cites divergent case law (Court of Appeal in Łódź, Court of Appeal in Białystok) and scholarly arguments to show that bailiffs do not fall under the entrepreneur categories of Article 81(2) of the Health Care Act. In conclusion, the gloss advocates applying Article 81(2za) of that Act to bailiffs, meaning their health insurance contributions should be calculated from a fixed base amount.
