STRESZCZENIE

W niniejszym opracowaniu omówiono kolejne przepisy Kodeksu postępowania cywilnego zmodyfikowane przez art. 1 ustawy z dnia 9 marca 2023 r. W pierwszej kolejności przeanalizowano zmianę art. 98 § 1(1) k.p.c., a zatem uregulowaną expressis verbis powinność orzekania przez sąd z urzędu o odsetkach od zasądzonych kosztów postępowania. Następnie omówiono zmianę art. 98 § 2 k.p.c., mocą którego podwyższono stronie działającej bez zawodowego pełnomocnika kwotę przysługującą z tytułu zwrotu kosztów procesu. Na zakończenie omówiono zmianę art. 98(1) § 1 k.p.c. dotyczącą górnej granicy kwoty przysługującej stronie wygrywającej proces z tytułu zwrotu kosztów mediacji.

ABSTRACT

Costs of Proceedings and Costs of Mediation. Commentary on Art. 98 and 98(1) of the Code of Civil Proceedings Amended with the Act of 9 March 2023

This paper discusses consecutive regulations of the Code of Civil Proceedings modified with art. 1 of the Act of 9 March 2023. First of all, amendment to art. 98 § 1(1) of the Code has been analysed, namely the regulated expressis verbis obligation of the court to adjudicate ex officio on interest on already adjudicated costs of proceedings. Next, the amendment to art. 98 § 2 of the Code of Civil Proceedings has been discussed, under which a party acting without a professional attorney has become entitled to a higher amount due to the reimbursement of trial costs. Finally, the modification of art. 98(1) § 1 has been presented, which concerns an upper limit of an amount due to a party that wins a trial due to the reimbursement of costs of mediation.
