STRESZCZENIE

Osiągnięcie porozumienia przez dłużnika i wierzycieli w trakcie postępowania restrukturyzacyjnego wymaga stworzenia warunków, w których wzajemne stanowiska stron zostaną skonfrontowane. Udzielenie dłużnikowi ochrony przeciwegzekucyjnej może ułatwić ten proces. Prawidłowość tę dostrzega ustawodawca. W ostatniej nowelizacji prawa restrukturyzacyjnego przewidziano nowe rozwiązania dotyczące ochrony przeciwegzekucyjnej w trakcie postępowania o zatwierdzenie układu z obwieszczeniem. Ochrona ta polega na odpowiednim zastosowaniu regulacji dedykowanej postępowaniu sanacyjnemu. Sposób odpowiedniego zastosowania przepisu budzi jednak wątpliwości w odniesieniu do uchylenia zajęć oraz przelania sum uzyskanych w zawieszonym postępowaniu egzekucyjnym.

ABSTRACT

The Impact of Proceedings for Approval of an Arrangement with an Announcement on Enforcement Proceedings

Reaching an agreement between the debtor and creditors during restructuring proceedings requires the creation of conditions in which the parties’ mutual positions are confronted. Providing the debtor with anti-enforcement protection may simplify this process. This regularity is recognized by the legislator. The latest amendment to the restructuring law provides for new solutions concerning anti-enforcement protection during proceedings for approval of an arrangement with an announcement. This protection consists in appropriate application of the regulation dedicated to the remedial procedure. The manner of appropriate application of the provision raises doubts with respect to setting aside seizures and transferring sums obtained in suspended enforcement proceedings.
