STRESZCZENIE

Niniejsze opracowanie stanowi komentarz do zmian w postępowaniu cywilnym wprowadzonych ustawą z dnia 9 marca 2023 r. Na wstępie zamieszczono uwagi wprowadzające do tego komentarza. W ich ramach dokonano ogólnej oceny ustawy z dnia 9 marca 2023 r. oraz przedstawiono problematykę odpowiedniego stosowania przepisów prawa w postępowaniu egzekucyjnym. Następnie omówiono zmiany właściwości rzeczowej sądu, a zatem art. 17 pkt 4 k.p.c. Na zakończenie przedstawiono zmianę art. 49 § 2 k.p.c., a zatem przepisu regulującego problematykę wyłączenia sędziego.

ABSTRACT

Subject-Matter Competence of Court and Judge Exclusion. Introduction to and Comment on Provisions of art. 17 and 49 Code of Civil Proceedings Amended with the Act of 9 March 2023

This paper constitutes a comment on an amendment to the civil proceedings introduced with the Act of 9 March 2023. The introduction contains preliminary notes on the comment. They include the general assessment of the Act of 9 March 2023 and introduce the problems of the adequate application of laws in enforcement proceedings. Next, a change of the subject-matter jurisdiction of a court has been discussed, namely art. 17(4) of the Code of Civil Proceedings. Finally, an amendment to art. 49 § 2 of the Code of Civil Proceedings has been presented, i.e. the regulation that governs the problem of excluding a judge.
