STRESZCZENIE

W niniejszym opracowaniu analizie poddano – w warstwie teoretycznej oraz praktycznej – przepisy postępowania odnoszące się do egzekucji obowiązku wydania rzeczy ruchomej. Rozważania oparto na znacznym dorobku doktryny oraz istotnym, z punktu widzenia organu egzekucyjnego, orzecznictwie Sądu Najwyższego.
Głównym założeniem opracowania jest ujęcie istoty wydania rzeczy na gruncie prawa materialnego oraz postępowania egzekucyjnego, jak również wskazanie istotnych, z punktu widzenia organów egzekucyjnych i wierzycieli, uwag de lege lata.

ABSTRACT

Enforcement of the Duty to Release a Movable Property

The study analyses, both in a theoretical and practical dimension, regulations of proceedings for the enforcement of a duty to hand over a movable property. The considerations have been based on the significant achievements of doctrine as well as the judicature of the Supreme Court that is relevant from the point of view of an enforcement authority.
The main goal of the study is to capture the essence of the issue of release of movable properties under substantive law and enforcement proceedings, as well as to indicate significant, from the point of view of enforcement authorities and creditors, remarks in regard for current law.
