The Constitutional Standards for Legally Regulating the System of Financing Bailiff Enforcement

This article analyses the constitutional standards for the legal regulation of the bailiff enforcement financing system. To determine these standards, the case law of the Constitutional Tribunal was examined, as this undoubtedly influenced the regulations governing the system. The analysis focused on judgements concerning the legal nature of enforcement fees and the substantive content of the regulations governing these fees, particularly their legislative accuracy, as well as the courts’ moderation of their amount. This analysis has resulted in a number of directives for the legislator to follow when creating the provisions that make up the system of financing court enforcement.
