STRESZCZENIE

Przedmiotem artykułu jest analiza konstytucyjnych standardów prawnej regulacji systemu finansowania egzekucji komorniczej. W celu ich ustalenia zostało poddane badaniu orzecznictwo Trybunału Konstytucyjnego, które miało niewątpliwie wpływ na kształt przepisów normujących ten system. Przedmiotem analiz stały się wyroki dotyczące charakteru prawnego opłat egzekucyjnych, materialnej treści przepisów normujących te opłaty, w szczególności zaś ich poprawności legislacyjnej, a także miarkowanie ich wysokości przez sądy. Przeprowadzona analiza pozwoliła na sformułowanie wielu dyrektyw wynikających z Orzecznictwa Trybunału Konstytucyjnego, którymi powinien kierować się ustawodawca przy tworzeniu przepisów składających się na system finansowania egzekucji sądowej.

ABSTRACT

The Constitutional Standards for Legally Regulating the System of Financing Bailiff Enforcement

This article analyses the constitutional standards for the legal regulation of the bailiff enforcement financing system. To determine these standards, the case law of the Constitutional Tribunal was examined, as this undoubtedly influenced the regulations governing the system. The analysis focused on judgements concerning the legal nature of enforcement fees and the substantive content of the regulations governing these fees, particularly their legislative accuracy, as well as the courts’ moderation of their amount. This analysis has resulted in a number of directives for the legislator to follow when creating the provisions that make up the system of financing court enforcement.
