Seizure of Rights to Use an Internet Domain and a Right to a Website

This article discusses the seizure of virtual (digital) assets in the form of a right to use an Internet domain and a right to a website. It presents technical aspects of Internet domains and websites and analyses material and legal aspects in order to define the legal character of a right to use an Internet domain and a right to a website. Then, it refers to issues related to the seizure of those rights based on debt collection regulations (Art. 895 to 908(1) of the Civil Procedure Code) and other property rights (Art. 909 to 912 of the Civil Procedure Code). The article discusses the method and consequences of the seizure, as well as rights and obligations of a creditor and debtor, in detail. It also analyses actions that can be taken by a bailiff, including the territorial and national jurisdiction of such and authority.
