A Complaint in Enforcement Proceedings in Civil Cases under Art. 767(4) of the Civil Procedure Code – the Assessment of a Legal Regulation

The article discusses a complaint in court enforcement proceedings stipulated in Art. 767(4) of the Civil Procedure Code, including in particular doubts stemming from that article. At the beginning, it presents general characteristics of a complaint and then moves to detailed issues related, among others, to a court competent to hear such a complaint, the composition of the court or the object of the complaint. The article also makes an attempt to formulate de lege ferenda postulates concerning amendments to Art. 767(4) of the Civil Procedure Code.
