Does the Sale of Real Properties by Electronic Auction Allow for Faster Debt Collection?
Since 19 September 2021 the Civil Procedure Code has included regulations based on which real properties can be sold by electronic auction. Those regulations provide for many useful solutions, which not only reduce the risk of the development of a pandemic, but let attract a greater number of bidders and, consequently, achieve higher purchase prices, as well. The justification of the draft act, based on which the regulations were added to the Code, also indicates, however, that those regulations aim at accelerating debt collection from real properties. Thus, this article assesses the new solutions from that point of view and verifies whether the regulations allow for arranging for, holding and bidding under an electronic auction faster than in the case of a traditional auction.
