Justification of a Decision to Approve an Arrangement Before a Mediator and a Decision to Confirm the Enforceability of an Arbitration Court or an Arrangement Made Before it
A justification for decisions is a special aspect of courts’ activity in civil proceedings, including enforcement proceedings. At present, the rule applies that a justification is prepared only upon request of a party, to which an exception has been introduced in enforcement proceedings, in which a decision issued in camera hearing is justified by a court ex officio, where a party is entitled to an appeal measure, unless a special regulation provides for otherwise. Special rules have been also introduced in clause proceedings. The variety of enforcement titles provided for in regulations of Polish enforcement proceedings makes it reasonable to ask about the application of general regulations to special titles, in the form of enforcement titles that originate in mediation and arbitration proceedings. This article includes the assessment of a regulation that concerns the justification of judgments issued in clause proceedings, in the context of art. 794(2) § 2 and 3 Code of Civil Proceedings and responding to a question about the scope of applying the above-mentioned regulation to proceedings for the approval of a mediation arrangement and confirming the enforceability of a judgement of an arbitration court or an arrangement made before it.
The first part of the article presents general assumptions for preparing a justification in clause proceedings. In the following points, rules of preparing justifications have been analysed for decisions that concern the approval of an arrangement made before a mediator and judgments on confirming the enforceability of a judgement of an arbitration court and an arrangement made before it.
