Zakaz egzekucji z majątku dłużnika po wszczęciu postępowania restrukturyzacyjnego w świetle nowelizacji Prawa restrukturyzacyjnego z dnia 25 lipca 2025 roku

STRESZCZENIE

Jednym ze skutków wejścia w życie ustawy z dnia 25 lipca 2025 r. o zmianie ustawy – Prawo restrukturyzacyjne, ustawy – Prawo upadłościowe oraz ustawy o Krajowym Rejestrze Zadłużonych jest objęcie układem zawieranym w postępowaniu restrukturyzacyjnym wierzytelności zabezpieczonych rzeczowo. Pomimo że nowelizacja nie objęła przepisów normujących problematykę dopuszczalności postępowania egzekucyjnego po otwarciu postępowania restrukturyzacyjnego, to ich treść uległa znacznej modyfikacji. Polega ona przede wszystkim na tym, że niedopuszczalne stało się postępowanie egzekucyjne co do wierzytelności zabezpieczonych rzeczowo. W związku z tym bezprzedmiotowa jest część przepisów odnoszących się do prowadzenia postępowania egzekucyjnego po otwarciu postępowania restrukturyzacyjnego.

ABSTRACT

Prohibition of Enforcement Against the Debtor’s Assets Following the Commencement of Restructuring Proceedings in Light of the Amendment to the Restructuring Law of 25 July 2025

One of the consequences of the entry into force of the Act of 25 July 2025 amending the Restructuring Law Act, the Bankruptcy Law Act and the Act on the National Register of Debtors is the inclusion, within arrangements concluded in restructuring proceedings, of claims secured by rights in rem. Although the amendment did not formally modify the provisions governing the admissibility of enforcement proceedings following the commencement of restructuring proceedings, it has nevertheless significantly altered their substantive effect. In particular, enforcement proceedings in respect of claims secured by rights in rem are no longer permissible. As a result, certain provisions concerning the conduct of enforcement proceedings after the commencement of restructuring proceedings have become devoid of practical application.
