Enforcement Proceedings and Inventory Proceedings

This study examines the relationship between proceedings to establish an inventory list and enforcement proceedings initiated against heirs at the request of a creditor of the deceased.
Three key issues are addressed:
1. Whether the creditor, when submitting a motion to initiate enforcement, is required to limit the enforcement to the amount of the heir’s limited liability resulting from the value of the active estate, or whether it is the heir who must invoke the limitation of enforcement as a means of defending their rights.
2. The legal basis for suspending enforcement proceedings where the enforcement title includes a limitation of liability, and no inventory list has been drawn up at the time enforcement is initiated.
3. The timing and procedural implications of the heir invoking the limitation of liability.
