STRESZCZENIE

W niniejszym opracowaniu dokonano przedstawienia i oceny przyszłych zmian w Kodeksie postępowania cywilnego wynikających z ustawy z dnia 9 marca 2023 r. o zmianie ustawy – Kodeks postępowania cywilnego oraz niektórych innych ustaw. Nowelizacja ta istotnie ingeruje w obecny kształt postępowania zażaleniowego w sądowym postępowaniu egzekucyjnym. Zasadniczym założeniem tej nowelizacji jest wprowadzenie zażalenia do sądu drugiej instancji w przypadku postanowień sądu o najpoważniejszym ciężarze gatunkowym. Ponadto,
zarówno w postępowaniu rozpoznawczym, jak i egzekucyjnym, zażalenie będzie podlegało rozpoznaniu z uwzględnieniem stadialności postępowania. Niniejsze opracowanie stanowi przyczynek do oceny spodziewanej nowelizacji.

ABSTRACT

Evolution of the Provisions on Complaints in Judicial Enforcement Proceedings and the Devolutive Model of Complaint Proceedings

The article analyzes and evaluates the changes to the Code of Civil Procedure resulting from the act of March 9, 2023 amending the Act – Code of Civil Procedure and some other acts. This amendment introduces major changes in the scope of complaints in court enforcement proceedings. The purpose of the amendment is to introduce a complaint to the court of second instance in the case of court decisions of the most serious nature. In addition in proceedings to examine the case and in enforcement proceedings the amendment introduces the examination of the case taking into account the inter-instance proceedings. This study is a contribution to the assessment of the expected amendment.
