Breach of the Dignity of the Office of a Court Bailiff as a Disciplinary Offence

A breach of the dignity of the office of a court enforcement officer is – in addition to breach of the authority of that office and other breaches of professional ethics – one of the disciplinary offences listed in the catalogue of disciplinary offences set out in Article 222(1) of the Code of Court Enforcement Officers. However, the concept of the dignity of the office of a court enforcement officer has not been defined in the Act on Court Enforcement Officers. The absence of a legal definition of the dignity of the office of a court enforcement officer necessitates reference to case law, which has attempted to define it on a case-by-case basis. The aim of this article is to analyze the concept of the dignity of the office of a court bailiff and its breach, to identify acts constituting this disciplinary offence, and to define the relationship between a breach of the dignity of the office of a court bailiff and a breach of the rules of professional ethics.
