The Procedural Position of Debtors of Seized Claims or Rights in Judicial Enforcement Proceedings

Entities of enforcement proceedings proper include parties and other participants, their position and/or scope of legal protection occasionally diverse. In cases involving receivables garnishment-based judicial enforcement, remuneration garnishment included, the role of the garnishee is of particular importance, their actions or omissions frequently determining the effectiveness of proceedings in progress. Should the judgement debtor be the acting creditor for a third party, such circumstance gives rise to the option of applying enforcement mechanisms to the debtor of the seized claim or right, i.e. an entity that was neither a party to litigation nor named in the enforcement order. That entity’s legal position is one of obligation to follow specific procedural duties. They are under obligation to meet benefit-related requirements with the judgement debtor omitted in the process, and provide the respective enforcement authority with all information as required on pain of procedural sanctions. That entity shall also be liable for compensation to the enforcing creditor, who may assume the rights of the debtor vis-à-vis the garnishee. The catalogue of burdens and obligations imposed on the garnishee is ample proof of how complex the issue of compulsory enforcement of cash considerations is, including matters arising at the intersection of substantive law and judicial enforcement.
