Gloss on Judgement of the Court of Appeal in Warsaw of 8 April 2022, II AKa 266/21
The court ruling commented on focuses on two key concepts, namely mortgage and frustrating the performance of a court ruling based on using a legal option to dispose of mortgaged real estate. The ruling points to the necessity to introduce changes in the present content of art. 300 § 2 of the Penal Code, because the present situation may cause uncertainty as to a legal position of a debtor encumbered with mortgage. In the proposed solution it is postulated to supplement the existing description of a prohibited act, namely the penalization not only of frustrating the performance of a court ruling but also of an attempt at its hindering.
