Judicial Enforcement of Regulated Movable Property in the Form of Firearms

Enforcement against firearms as regulated items may pose numerous practical problems for court bailiffs, while at the same time constituting an effective means of satisfying the creditor’s claim. The purpose of this study is to analyse the procedure for determining the firearms possessed by the debtor, their seizure, and their sale in the context of the applicable legal provisions. Numerous issues that may create difficulties for the enforcement authority are identified, arising at each stage of the enforcement proceedings. The procedure for determining the firearms to which the debtor is entitled, the manner of their seizure, issues of custody, and the specific features of their sale, taking into account the regulation of trade, are discussed in detail. The issue of the valuation of individual firearms is also addressed. Consideration is likewise given to matters that may arise if enforcement against movable property consisting of firearms becomes more widespread.
