ABSTRACT
A Creditor’s Filing of an Application to Establish the Acquisition of Inheritance after a Deceased Debtor and the Interruption of the Limitation Period for the Claim

This article discusses the impact of a creditor’s filing a motion to establish the acquisition of an estate after a deceased debtor on the running of the statute of limitations for the creditor’s claim initiating such proceedings. In the author’s opinion, filing such a motion does not constitute an act directly aimed at pursuing, establishing, satisfying, or securing a claim within the meaning of Article 123 § 1 item 1 of the Civil Code and therefore does not interrupt the statute of limitations. This view is not contradicted by the Supreme Court’s opposing position regarding the interruption of the statute of limitations for claims for compulsory share.
