ABSTRACT
A Guardian by Appointment of Court for a Debtor in Enforcement Proceedings Based on Art. 818(1) of the Code of Civil Procedure

The author presents the purpose and motives for the introduction of the institution of a conservator appointed on the basis of Art. 818(1) of the Civil Procedure Code by an enforcement court for a debtor being a business unit in connection with gaps in that business unit’s authorities. The author discusses premises for the appointment of a conservator that are stipulated by law and distinguishes the operating area of an enforcement court and a bailiff. The author points out that there are no regulations which clearly define competences of a conservator appointed on the basis of Art. 818(1) of the Civil Procedure Code and that the legislator completely omits the co-existence of a conservator with conservators appointed on other legal basis, including in particular a conservator appointed on the basis of Art. 42 of the Civil Code.
