In the commentary to the resolution of the Supreme Court of June 7, 2023, III CZP 153/22, it approved the view expressed therein that a final decision containing a plan for the division of the sum obtained from real estate enforcement, in which the bailiff named the person for whom the sum is intended due from the buyer, issued pursuant to Art. 1037 § 2 of the Code of Civil Procedure and constituting an enforcement title against the purchaser of the real estate, constitutes the basis for the entry in the land and mortgage register of a mortgage created by operation of law itself (Article 1037 § 3 of the Code of Civil Procedure), without the court attaching an enforceability clause to the enforcement title thus created. In the opinion of the glossator, it should not be assumed that due to Art. 109 section 1 of the Act of July 6, 1982 on land and mortgage registers and mortgages, it is necessary for the enforcement title in the form of the above-mentioned decision to be provided by the court with an enforcement clause, even though the mortgage is created by operation of law itself, regardless of the entry in the land and mortgage register. This last provision refers to compulsory mortgage, not statutory mortgage.
