Claiming the Statute of Limitations in Proceedings for Re-issuing an Enforcement Title Instead of a Lost One. Gloss to the Resolution of the Supreme Court of April 7, 2022, III CZP 44/22
In the gloss to the resolution of the Supreme Court of April 7, 2022, III CZP 44/22, the position expressed therein was approved that in proceedings for re-issuing an enforcement title instead of a lost one, the court does not examine whether the claim covered by the enforcement title has expired (Article 794 k.p.c.). In the opinion of the glossator, such a view, unequivocally based on the last sentence of Art. 794 of the Civil Procedure Code, is also valid after the amendment to the Code of Civil Procedure made by the Act of July 4, 2019 amending the Act – Code of Civil Procedure and certain other acts. It is also supported by the arguments of systemic and functional interpretation.
