Keeping a Deadline for Filing a Pleading, Reopening Suspended Proceedings, Granting Costs of a Mediator, Mediation Protocol and Settlement Executed Before a Mediator. Comment on art. 165, 181, 183(5), 183(13) and 183(14) of the Code of Civil Proceedings, Amended with the Act of 9 March 2023

This article discusses consecutive regulations of the Act of 9 March 2023 amending regulations of the Code of Civil Proceedings. First of all, a comment was presented on the amended art. 165 § 2 of the Code of Civil Proceedings concerning an impact of filing a letter at a post office of a state belonging to the European Union (including Poland) in order to keep a deadline for filing a pleading. Next, the amended regulation of art. 181 § 1 of the Code of Civil Proceedings was discussed that governs the reopening of suspended proceedings upon request of a party. The following comments concern regulations included in three articles that apply to mediation proceedings. The first
one (art. 183(5) § 2, 3 and 4 of the Code of Civil Proceedings) governs the problems of reimbursing costs of mediation to a mediator. The second of the articles (art. 183(13) § 2 of the Code of Civil Proceedings) concerns the submission of a mediation protocol to a court and the scope of settlement made before a mediator. The third article (art. 183(14) § 21 of the Code of Civil Proceedings) deals with the content and effects of a settlement executed before a mediator and encompasses claims being the subject matter of varied court proceedings.
