Egzekucyjne i pozaegzekucyjne dochodzenie świadczeń alimentacyjnych

STRESZCZENIE

W niniejszym artykule omówiono szczególne reguły egzekucyjnego i pozaegzekucyjnego dochodzenia świadczeń alimentacyjnych w polskim systemie prawnym. Punktem wyjścia do przedmiotowych rozważań jest podkreślenie konstytucyjnej ochrony rodziny i dziecka, która uzasadnia uprzywilejowaną pozycję procesową wierzyciela alimentacyjnego. W opracowaniu wyjaśniono pojęcia alimentów i renty o charakterze alimentów. Szczególną uwagę poświęcono uprzywilejowanej pozycji wierzyciela alimentacyjnego: rozszerzeniu jego uprawnień, jeżeli chodzi o wybór komornika właściwego dla świadczeń alimentacyjnych, czy ograniczeniu wymogów formalnych wniosku egzekucyjnego. Zauważono też, że egzekucja świadczeń alimentacyjnych charakteryzuje się także podniesionym zakresem egzekucji w przypadku określonych sposobów egzekucji. Poruszono ponadto kwestię roli sądu w sprawach egzekucji świadczeń alimentacyjnych oraz wskazano na pozaegzekucyjne sposoby zaspokojenia tych roszczeń. Całość przytoczonych badań ma na celu ukazanie systemowego uprzywilejowania dochodzenia alimentów jako świadczeń o charakterze egzystencjalnym.

ABSTRACT

Enforcemenet and Non-enforcement Recovery of Maintenance Payments

This academic article discusses the specific rules governing the enforcement and non-enforcement recovery of maintenance payments within the Polish legal system. The starting point for these considerations is the emphasis on the constitutional protection of the family and the child, which justifies the privileged procedural position of the maintenance creditor. The article explains the concepts of maintenance and maintenance-type payments. Particular attention is paid to the privileged position of the maintenance creditor – including the extension of their powers regarding the selection of the bailiff competent for maintenance payments and the reduction of formal requirements for the application for enforcement. The author notes that the enforcement of maintenance payments is also characterised by an increased scope of enforcement in the case of specific enforcement methods. The article addresses the role of the court in maintenance enforcement cases and highlights non-enforcement methods of satisfying such claims. The aim of the research cited is to demonstrate the systemic prioritisation of maintenance payments as benefits of an existential nature.
