Rygor natychmiastowej wykonalności wyroku zaocznego. Uwagi na tle ochrony procesowej pozwanego

STRESZCZENIE

W opracowaniu dokonano analizy problematyki rygoru natychmiastowej wykonalności wyroku zaocznego z perspektywy ochrony procesowej pozwanego. Przedstawiono przesłanki nadania, zawieszenia i uchylenia rygoru oraz oceniono skuteczność dostępnych środków ochrony pozwanego. Autor wskazuje na luki w obowiązujących regulacjach oraz formułuje postulaty interpretacyjne i de lege ferenda, zmierzające do wzmocnienia gwarancji procesowych pozwanego.

ABSTRACT

The Immediate Enforceability of a Default Judgment. Remarks on the Procedural Protection of the Defendant

The article analyzes the issue of the immediate enforceability of default judgments from the perspective of the defendant’s procedural protection. It presents the grounds for granting, suspending, and revoking immediate enforceability, and assesses the effectiveness of the available means of protection for the defendant. The author points to gaps in the current regulations and formulates interpretative and de lege ferenda proposals aimed at strengthening the procedural guarantees of the defendant.
